1. PROMOTER
This prize draw (the "Promotion") is promoted by Theatrical Rights Worldwide Ltd ("TRW" or the "Promoter"), located at 19 Margaret Street, 3rd & 4th Floors, London, W1W 8RR, UK. TRW may be contacted via email at london@theatricalrights.com or through its official social media accounts. The Promoter may delegate aspects of the administration of this Promotion to an appointed agent.
2. LEGAL FRAMEWORK AND COMPLIANCE
This Promotion is a free prize draw conducted in accordance with:
- The Gambling Act 2005 (as amended). Because entry is free of charge, this Promotion does not constitute a lottery under the Act and is not regulated by the Gambling Commission;
- The UK Code of Non-broadcast Advertising and Direct & Promotional Marketing (the “CAP Code”), Section 8, as administered by the Advertising Standards Authority (“ASA”);
- The Consumer Protection from Unfair Trading Regulations 2008;
- The Consumer Rights Act 2015;
- The UK General Data Protection Regulation (“UK GDPR”) and the Data Protection Act 2018.
The Promoter is committed to conducting this Promotion equitably, promptly, and efficiently, and to treating all participants fairly and honourably, as required by CAP Code Rule 8.2.
3. ELIGIBILITY
The Promotion is open to residents of Great Britain (England, Scotland, and Wales) aged 18 or over at the time of entry, except:
- Employees, officers, directors, contractors, and agents of Theatrical Rights Worldwide Ltd and its affiliates, subsidiaries, and advertising or promotional agencies;
- Immediate family members (spouse, civil partner, parent, child, or sibling) or members of the same household as any such employee;
- Any person professionally connected with the administration of this Promotion.
Northern Ireland: Entry from residents of Northern Ireland is not permitted. Under the Betting, Gaming, Lotteries and Amusements (Northern Ireland) Order 1985, free prize draws of this nature are subject to different rules in Northern Ireland and the Promoter has elected to exclude Northern Ireland from eligibility for this Promotion.
By entering, each participant confirms that they meet all eligibility requirements. The Promoter reserves the right to verify eligibility at any stage and to disqualify any entrant or winner who is found not to meet the requirements.
4. PROMOTION PERIOD
The Promotion opens and closes on the dates and times specified in the individual prize draw post on TRW’s official social media account(s) (the "Promotion Period"). Entries received outside the Promotion Period will not be eligible. All times are Greenwich Mean Time (GMT) or British Summer Time (BST), as applicable. The Promoter’s systems are the official timekeeping device for this Promotion. The Promoter will not extend the Promotion Period except in circumstances of genuine force majeure or technical failure beyond its reasonable control, and entrants who entered prior to any extended closing date will not have their odds of winning reduced without reasonable justification.
5. HOW TO ENTER
Entry is free of charge. No purchase is necessary or required. To enter the Promotion during the Promotion Period, participants must:
- Follow @TRWShowsUK on the applicable social media platform (Instagram, Facebook, X/Twitter, or such other platform as designated in the specific giveaway post); and
- Complete any additional entry steps described in the official prize draw post, which may include liking the post, leaving a comment, tagging another account, or sharing the post to their story, as specified.
Limit one (1) entry per person per Promotion unless otherwise stated. Entries submitted in excess of the stated limit will be void. The use of automated entry methods, bots, scripts, macros, or any other mechanical or electronic means to enter is prohibited and will result in disqualification.
The Promoter will only accept entries submitted through verifiable means. Entry conditions will be designed so that eligibility can be confirmed before a winner is selected. Any entry mechanic (such as sharing to stories or bonus actions) that cannot be verified by the Promoter prior to the draw will not be used as a qualifying entry requirement.
Postal Entry (Alternative Free Method of Entry): To enter without using social media, send a handwritten postcard including your full name, postal address, date of birth, and the name of the specific Promotion to: TRW Prize Draw, Theatrical Rights Worldwide Ltd, [UK Office Address]. Postal entries must be received before the close of the Promotion Period. Limit one (1) postal entry per envelope.
6. PRIZE
The prize(s) to be awarded are as described in the specific prize draw post on TRW’s official social media account(s). Prizes may include, without limitation, tickets to theatrical productions, merchandise, or other items related to TRW’s catalogue of theatrical works and licensing activities.
The prize is as described and no cash alternative will be offered. The Promoter reserves the right to substitute any prize with an alternative of equal or greater value in the event that the stated prize becomes unavailable for reasons beyond its control. Appropriate steps will be taken to inform the winner of any substitution.
The prize is non-transferable, non-negotiable, and cannot be sold, exchanged, or redeemed for cash. The prize is personal to the winner.
Tax: Prizes are not subject to VAT in the hands of the winner. However, winners are responsible for any personal tax liability that may arise from receipt of a prize. The Promoter makes no representation regarding the tax treatment of any prize and recommends that winners seek independent tax advice if in doubt.
7. WINNER SELECTION AND NOTIFICATION
The winner(s) will be selected by a genuinely random process from among all eligible entries received during the Promotion Period, in accordance with CAP Code Rule 8.24. Where a computer-based random selection process is used, the Promoter will maintain evidence of the random and verifiable nature of the process and will provide this to the ASA if required. Where a computer process is not used, the draw will be conducted or supervised by an independent person not connected with the Promotion.
The Promoter will make reasonable and documented attempts to contact the winner(s) by direct message on the applicable social media platform, or by such other contact method as provided at the time of entry. In accordance with CAP Code guidance, a single contact attempt will not be deemed sufficient. The Promoter will make multiple attempts via different methods where possible.
If a winner cannot be contacted, fails to respond within fourteen (14) days of the first notification attempt, or is found to be ineligible, the Promoter reserves the right to select an alternative winner by the same random process.
Any time limit imposed on a winner for claiming a prize will be stated clearly in these terms and in the prize draw post. Failure to claim a prize within the stated period will result in forfeiture.
Winner Announcement: In accordance with CAP Code Rule 8.28.5 (as amended in line with UK GDPR), the Promoter will make available, upon request, information confirming that a valid award took place. This will ordinarily comprise the winner’s surname and county/region. Entrants are informed of this practice at the time of entry and may object to the publication of their details by contacting the Promoter before any announcement is made. Where an entrant objects, the Promoter will provide the required information privately to the ASA if challenged. The Promoter will seek the winner’s express consent to any further publicity before sharing additional personal information.
8. DATA PROTECTION AND UK GDPR
The Promoter is the data controller in respect of personal data collected in connection with this Promotion. Personal data will be collected and processed in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
Personal data collected (which may include name, social media username, contact details, and postal address) will be used solely for the purpose of administering the Promotion, including contacting and verifying winners. Data will not be used for direct marketing without separate, freely given consent.
Entry into this Promotion does not constitute consent to receive marketing communications. Any separate consent to marketing is entirely voluntary and will not affect eligibility or odds of winning.
Personal data will be retained only for as long as is necessary for the purposes for which it was collected, and will be securely deleted thereafter. Participants have the right to access, rectify, erase, restrict, or object to the processing of their personal data, and the right to data portability, in accordance with applicable law. 9. LIMITATION OF LIABILITY
Nothing in these terms and conditions shall limit or exclude the Promoter’s liability for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
Subject to the above, and to the fullest extent permitted by law, the Promoter and its officers, employees, agents, affiliates, and advertising or promotion agencies (together, the “Released Parties”) shall not be liable for:
- Any loss, damage, injury, disappointment, or inconvenience suffered in connection with entry into or participation in the Promotion;
- Any loss or damage arising from the acceptance, possession, or use of any prize;
- Any failure or delay in awarding a prize due to circumstances beyond the Promoter’s reasonable control;
- Any technical failures, network errors, or other issues affecting entry or administration of the Promotion;
- Any error, omission, or inaccuracy in materials produced by third-party service providers.
The Promoter accepts no responsibility for entries that are lost, delayed, corrupted, or misdirected due to reasons outside its control, including failures of social media platforms.
10. ENTRIES AND INTELLECTUAL PROPERTY
Entries will not be returned. To the extent that an entry contains original creative content submitted by the entrant, the entrant retains ownership of that content. However, by entering, each entrant grants the Promoter a non-exclusive, royalty-free, worldwide licence to reproduce, publish, and display entry content for purposes directly connected with the administration and promotion of this Promotion only.
The Promoter will seek separate consent from winners before using their name, image, or likeness for any broader commercial or publicity purpose, in compliance with UK GDPR.
11. DISQUALIFICATION
The Promoter reserves the right, in its sole discretion, to disqualify any entrant who:
- Does not meet the eligibility requirements set out in these terms;
- Provides false, inaccurate, or misleading information;
- Tampers with the entry process or otherwise acts in a manner that is fraudulent, dishonest, or disruptive;
- Breaches these Official Rules or the terms of service of the applicable social media platform;
- Uses multiple accounts or automated means to enter beyond any stated limit;
- Acts in an offensive, abusive, or unsportsmanlike manner.
12. GENERAL CONDITIONS
The Promoter reserves the right to cancel, suspend, or amend the Promotion at any time where it has reasonable grounds to do so (including technical failures, fraud, force majeure, or circumstances outside its reasonable control), provided that it takes all reasonable steps to minimise disruption to participants and to honour the original terms where possible. Entrants who have entered in good faith prior to any amendment will not have their chances of winning materially affected without justification.
The Promoter’s decisions on all matters relating to the Promotion are final, subject to participants’ rights to raise a complaint. All participants agree to be bound by these Official Rules.
This Promotion is in no way sponsored, endorsed, administered by, or associated with Facebook, Instagram, X (formerly Twitter), TikTok, YouTube, or any other social media platform on which it is promoted. Any questions, comments, or complaints should be directed to TRW, not to the relevant platform.
This Promotion complies with the CAP Code and applicable consumer protection law. Where this Promotion is advertised on social media, the Promoter will clearly identify all significant conditions (including start and end dates, prize description, and eligibility restrictions) in the promotional post or via a clearly signposted link to these terms.
13. COMPLAINTS
If a participant believes that this Promotion has not been administered in accordance with these terms or the CAP Code, they may contact the Promoter in the first instance at london@theatricalrights.com. The Promoter will investigate and respond promptly and fairly.
Participants may also refer a complaint to the Advertising Standards Authority (ASA) at www.asa.org.uk if they believe the Promotion or its advertising has breached the CAP Code.
14. GOVERNING LAW
These Official Rules and any dispute or claim arising out of or in connection with this Promotion (including any non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales. The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Promotion.
